Title of bill
An act to amend the mental hygiene law, in relation to requiring municipal approval of community residential facility site selection and to require a public hearing on such siting and to amend the real property tax law, in relation to removing the tax exemption for community residences
Purpose
To provide that group home sponsors cannot select a site or a group home absent approval by local elected officials, together with a provision that a public hearing be made mandatory relative to the location of group homes, as well as a provision that group homes be required to pay all property and school taxes as would any other residence.
Summary of provisions
Sec. 1--amends Subdivision (c) of section 41.34 of the Mental Hygiene Law, as amended by Chapter 1024 of the laws of 1981, Subparagraph (c) of paragraph 1 as amended by Chapter 823 of the laws of 1992, is amended to require municipal approval of and a public hearing on the siting of community residential facilities and to remove the property tax exemption for such.
Justification
This legislation would require the sponsoring agency of a community residential facility to notify a municipality in writing of the address, type of residence, number of residents, community support requirements and any other pertinent information on a proposed residential facility. Upon notification, the municipality shall conduct a public hearing concerning the site selection of such facility within thirty days of such notice.
The intent of this legislation is to address the concern about the placement of group homes in residential neighborhoods without the benefit of significant input or direction from local elected officials. A public hearing is necessary in order to achieve a balance between the rights of group home sponsors and the rights of residents of neighborhoods.
