Title of bill

An act to amend the environmental conservation law and the agriculture and markets law, in relation to the regulation of aquaculture; to amend the environmental conservation law and the state finance law, in relation to making technical changes thereto; and to repeal certain provisions of the environmental conservation law relating to the regulation of aquaculture

Purpose

Provides for aquaculture and shellfish regulation.

Summary of provisions

Environmental Conservation Law, Agriculture and Markets Law and State Finance Law are amended to allow for regulation of aquaculture and shellfish.

Justification

The Department of Environmental Conservation (DEC) has traditionally regulated all forms of aquaculture. However, the regulation and development of aquaculture as a commercial enterprise for food could best be administrated by the Department of Agriculture and Markets. DEC's focus has been the regulation of aquaculture as game fish except in the case of farmed shell fish, DEC regulates the commercial harvest as well as disease control.

The Department of Agriculture is charged with providing for the safety of the food we purchase for human consumption. They are also charged to establish various promotional programs to enhance food production across the state which ultimately enhances the economy. This legislation would give the Department of Agriculture and Markets the authority to regulate commercial fish or shellfish production for sale as a live or processed food product by fish farms certified by the Department. The regulation of game fish would still be performed by the DEC. A correlation would be that DEC regulates the wild deer population including the harvest for human consumption while commercial deer farms, where deer are grown and harvested for consumption is regulated by the Department of Agriculture and Markets.
