Title of bill
An act to amend the agriculture and markets law, in relation to labeling and sale of cloned or genetically engineered meat, eggs and dairy products
Purpose or general idea of bill
Requires the labeling of meat and dairy products as "clone-free" where the product is not a product of genetic engineering or from a cloned animal or its progeny.
Summary of specific provisions
Clone-free shall mean that such meat, meat preparations, meat by-products, poultry, eggs or other dairy food or dairy food products are not the product of genetic engineering, or from a cloned animal or its progeny. Sellers of meat, eggs and dairy products shall indicate on the label or display sign that such product is "clone-free." Sellers shall maintain records of purchases from a producer, distributor, manufacturer or packer of "clone-free" products.
Failure to comply with the requirements of this bill shall be punishable by a fine of not more than one thousand dollars for a first violation; not more than five thousand dollars for a second violation; and not more than ten thousand dollars for a third violation and each subsequent violation thereafter.
Justification
While cloned food products are not yet on the market, the naturally born offspring of clones could appear within the next few years. A December 2006 survey by the Pew Initiative on Food and Biotechnology found 64% of Americans were "uncomfortable" with animal cloning. The NYS Assembly is already on the record against reproductive cloning. Given the short history of cloning, little data from long-term, multi-generational studies is available. Consumers should have a choice of what meat they buy, especially considering the public's widespread discomfort with cloning.
