Title of bill

An act to amend the education law, in relation to regulatory mandates

Purpose

Provides that regulatory mandates imposed upon a school district shall not take effect until the subsequent school year.

Summary of provisions

This legislation defines "regulatory mandates" as a rule enacted by the Board of Regents, the Commissioner of Education, or any employee of the State Education Department which requires a school district to create a new program, requires a higher level of service for a current program, or alters a program in a manner that increases the operational cost to a school district. If a regulatory mandate is imposed upon a school district after the adoption of a budget, it shall not take effect until the subsequent school year. Regulatory mandates can be imposed if it is provided as an option to the school district, if it is from an executive order of the governor, or if it is required by a statute that implements a federal law or regulation.

Justification

School districts are faced with mandates every year from the Board of Regents and the State Education Department. Not only are many of these mandates which the Board of Regents or the State Education Department place on school districts unfunded, but the districts have not had the the opportunity to plan for them in their current budget. This bill will give districts the opportunity to plan for the costs incurred by such mandates.
