Title of bill
An act to amend the public health law, in relation to prohibiting casino advertising near certain locations
Purpose
This legislation will prevent all advertising within one thousand feet of any school, day care center, playground or youth center.
Summary of provisions
This bill amends the Public Health Law, to prohibit those in the business of advertising casinos from doing so within one thousand feet of school grounds, child day care centers, playgrounds and youth centers. Hearings pursuant to Article 13-E of the Public Health Law will determine whether a violation has occurred. The penalty for a first offense is a fine of at least $250, not to exceed $500. A second offense bears a penalty of at least $500 and not more than $1000. Subsequent violations require penalties of at least $1000.
Justification
This bill prohibits the advertising of casinos, which are illegal in New York State, near all schools, day care centers, playgrounds and youth centers. Prohibiting such advertisements near those places where children congregate and spend much of their time furthers the state's policy against casino gambling and protects children from the possible hazard they present.
