Title of bill

An act to amend the election law, in relation to provisions for watchers

Purpose

The bill authorizes voters registered in a party to be poll watchers in any county in the State.

Summary of provisions

Section 1: Amends Election Law section 8-500(4) to require that watchers be qualified to vote in the State.

Section 2: Provides for the Act to take effect immediately.

Existing law

Under current law, a poll watcher must be registered to vote in the county in which he is to serve.

Justification

A candidate currently cannot have a campaign worker or supporter serve as a poll watcher in any county other than the one in which that campaign worker or employee resides. This places an unreasonable, unwarranted and probably unconstitutional burden on a candidate's ability to have poll watchers present in the polls throughout that candidate's district and serves no legitimate purpose.
