Title of bill
An act to amend the criminal procedure law, in relation to granting certain federal law enforcement officers the power to act as peace officers; and to repeal subdivision 6 of section 2.15 of such law relating to Federal Protective Officers
Purpose
To amend Section 2.15 of the Criminal Procedure Law to reflect a change in title of certain federal law enforcement officers which resulted from the restructuring of several federal agencies under the Homeland Security Act of 2002 enacted by Congress.
Summary of provisions
Section 1 amends Subdivisions 3 and 7 of Section 2.15 of the Criminal Procedure Law to reflect the change in title of certain federal law enforcement officers formerly employed in the U.S. Customs Service, Immigration and Naturalization Service and General Services Administration.
Section 2 repeals Subdivision 6 of Section 2.15 of the Criminal Procedure Law.
Existing law
The federal law enforcement officers covered by this bill were previously known by different titles and are designated as federal law enforcement officers in Subdivisions 3, 6, and 7 of Section 2.15 of the Criminal Procedure Law.
Justification
The Homeland Security Act of 2002, enacted by Congress and signed by the President resulted in an organizational restructuring of various federal agencies and transferred certain law enforcement personnel of the US Customs Service, the Immigration and Naturalization Service and the US Customs Federal Protective Service (formerly part of the General Services) to a newly reorganized US Customs and Border Protection and US Immigration and Customs Enforcement. This bill merely codifies the new titles of federal law enforcement officers who are currently designated by their former titles in the Criminal Procedure Law.
