Title of bill
An act to direct the public service commission to prepare a report on the impact of the proposed elimination of portions of the public service law and of title 16 of the New York NYCRR and proposed changes to said commission's practices with regard to the enforcement of existing portions of said law and of the NYCRR concerning universal access to adequate and affordable telephone service, consumer protection, and service quality
Purpose
The legislature finds that universal access to affordable telephone service, consumer protection, and quality telephone service has been a long standing tradition and policy of the state. However, this policy has come into question with proposals by the department of public service to deregulate the telecommunications industry in New York by eliminating or failing to extend laws and rules relating to telecommunications services and companies. Universal service, long taken for granted, must now be re-evaluated to ensure that it survives such de-regulation; basic consumer protections must now be re-evaluated to ensure they survive de-regulation; and the provision of adequate service by telephone corporations, must now be re-evaluated to ensure such service quality survives de-regulation.
Summary of provisions
This bill would require the public service commission to immediately suspend II competition III case 05-C-0616, until after commission has issued a report on the potential effects of such proceedings.
Justification
Universal access to affordable telephone service, consumer protection, and quality telephone service has been a long-standing tradition and policy of the state and has secured economic benefits to the state and its citizens. However, this policy has come into question with proposals by the department of public service to deregulate the telecommunications industry in New York by eliminating or failing to extend laws and rules relating to telecommunications services and companies.
