Title of bill
An act to amend the criminal procedure law, in relation to persons designated as peace officers
Purpose
Designates civil enforcement officers employed by Jefferson County sheriff's office as peace officers.
Summary of provisions
Amends section 2.10 of the criminal procedure law by adding a new subdivision 82.
Justification
This measure has been introduced at the request of the Jefferson County Sheriff's Office. Currently, these civil enforcement officers are limited in their legal ability to act. They go out into the county performing their duties, knocking on doors announcing themselves as Sheriff's Department, often dealing with the same people the county Deputy Sheriffs deal with.
In 2004, there was an incident in the county in which the civil enforcement officers were attempting to serve a warrant on a house. This same house later got raided by the Jefferson County Drug Task Force and it was discovered that it was a working methamphetamine lab. The fear is that one day one of these officer's will knock on a door and yell sheriff's department and have a gun blast come through the door.
Granting of peace officer status to the Jefferson County civil enforcement officers will aid them in performing their duties and avail them of the training such status provides. The Jefferson County Sheriff's Office is concerned that these civil enforcement officers are exposed to dangers and are unable to protect themselves.
