Title of bill

An act to direct the commissioner of education to recalculate certain state aid payments which may be payable to the Marlboro central school district; and to establish a 30 year period of probable usefulness for the payment of certain judgments by such school district

Purpose

The Marlboro Central School District includes the Danskammer and Roseton power plants. The established assessed real property value for these power plants have made the Marlboro Central School District appear to be very wealthy, subjecting the school district to reduced state aid as a result.

As has occurred in other parts of the State, after these power plants were sold by public utilities to private power producing consortiums, such new owners moved to significantly reduce (by approximately 90%) the assessed value of both plants. The power plant owners have succeeded in their tax certiorari proceedings. This means that past overpayments will require reimbursement by the taxing jurisdictions in which Danskammer and Roseton power plants are located. The overpayments may go back as far as fiscal year 2003.

Summary of provisions

Section 1: Adds a new unconsolidated law to allow for the filing of a court order or judgment pursuant to Education Law section 3604(5)(b). It allows for transmitting revised data to the Commissioner of Education pursuant to Education Law section 3603(1)(c) and certification of payments due as a result of a court order or judgment.

What this bill does is allow the school district to go back to that same period of time of reassessment and reconfigure the school aid for the Marlboro School District for the period of scheduled school property tax reimbursements to the power plant owners. The bill recognizes that the power plants have not been as much of an asset in previous years as was originally determined by Education Department in formulating state aid payments to the school district.

Existing law

None, but similar provisions have been enacted for the Haverstraw-Stoney Point School District in relation to power plants located in that jurisdiction.

Justification

This local school district needs to be made whole if the real property tax assessment is substantially reduced. Otherwise, real property tax assessments will increase rapidly for the taxpayers of this jurisdiction. The bill also allows the School District to bond no more than $ 11 million to spread out the cost of this new obligation.
