Title of bill
An act to amend the alcoholic beverage control law, in relation to the time and form for the furnishing of certain information to municipalities and community boards by applicants for certain original, renewal, or alteration alcoholic beverage licenses and the applicability of certain public notice requirements
Purpose
The bill would require that any applicant for a license, renewal or alteration of an alcoholic beverage license, notify the local municipality or community board not less than 60 days prior to the submission of the application.
Summary of provisions
The bill amends the alcoholic beverage control law by amending subdivision 5 of section 51, adding a new subdivision 1-a to section 54, adding a new subdivision 1-a to section 54-a, amending subdivision 2-a of section 55, adding a new subdivision 2-a to section 63, amending subdivision 2-a of section 64, adding a new subdivision 2-a to section 64-a, adding a new subdivision 2-a to section 64-b, amending subdivision 3 of section 64-c, amending subdivision 3 of section 64-d, amending subdivision 1-a of section 81, adding a new subdivision 1-a to section 81-a, amending subdivision 7 of section 100 and amending subdivision 1 of section 110-a to require applicants for a license or renewal of a liquor license to notify the appropriate entity at least 60 days prior to the submission of the application.
Justification
Many localities, and community boards of large areas have found that the current 30 days required for notification is not sufficient time to review the application since many of these boards only meet once a month. This bill will require the applicant to submit these notifications at least 60 days in advance to allow the localities and community boards time to review the application.
