Title of bill

An act to amend the canal law, in relation to the method of abandonment for the purposes of the canal system

Purpose or general idea of bill

This bill would make the method of abandonment for canal property more open for discussion by the general public within that municipality or locality to which a proposed sale of canal property is located.

Summary of specific provisions

Section one of this bill would amend Section 51 of the canal law, as amended by chapter 335 of laws of 2001, to require abandonment notices to be published in the newspaper in the county or the municipality or locality wherein such lands are located when there is such a newspaper. This amendment would also require that the corporation hold a public hearing, at which evidence or further information may be submitted, when it is the case that the assessment for such lands proposed for abandonment is equal to or greater than fifty thousand dollars. The current law says that the corporation MAY hold a public hearing. Section two provides for the effective date.

Justification

In large counties where there are more than one city, a person buying an abandoned piece of property owned by the canal corporation may do so without informing the citizens through a required public hearing in which it will occur. Because the current law requires notices to be published in a county newspaper, the person trying to buy the land should publish their purchase notice in the city or town located in that county if they have a local newspaper other than a county wide newspaper. By requiring that the corporation shall hold a public hearing, it invites interested parties to file oral or written statements either supporting or opposing the proposed abandonment.
