Title of bill
An act to authorize the city of North Tonawanda to alienate and convey certain waterfront real property
Purpose of the bill
This bill would authorize the City of North Tonawanda to alienate and convey a certain waterfront parcel of land.
Summary of specific provisions
§ 1- Notwithstanding the provisions of General City Law § 20 2) which bars cities from alienating waterfront land, this bill authorizes the sale of specific real property located on the waterfront in the City of North Tonawanda.
§ 2- The authorization contained in section one of this act shall take effect only upon the condition that the City of North Tonawanda dedicate an amount equal to or greater than the fair market value of the property being alienated in section three toward acquisition of additional water-front property and/or capital improvements to existing waterfront property:
§ 3- Describes the land authorized to be alienated.
§ 4- Effective date.
Justification
The property in question was a privately owned marina obtained by the City of North Tonawanda as a result of art In Rem tax proceeding. It was not acquired for public use and has been: leased to private groups for use as a marina. The proposed sale will return the parcel to the tax rolls and open up the property to more public use. The private developer plans to maintain and expand current marina facilities and convert the private clubhouse to a casual restaurant.
While the city is alienating this 2.3 acre parcel at 1010 River Road, it will be acquiring a 50.5 acre parcel, Gratwick-Riverside Park which is currently owned by National Grid and is situated next to the 1010 River Road parcel.
