Title of bill
An act to amend the public health law and the education law, in relation to the dispensing of three month supplies of drugs to treat chronic illnesses and conditions; and to amend the insurance law, in relation to requiring insurers to provide coverage of such three months supplies in the same manner coverage is provided for other prescriptions
Purpose
This bill authorizes dispensing of three month supply of drugs when used to treat or alleviate a chronic illness or condition.
Summary of provisions
The bill amends sections 3331, 3332, and 3333, subdivisions 5, 3 and 1. This legislation also amends section 3339 subdivision 2 of the public health law, to allow for the prescribing of controlled substances for a three month period. This applies to those substances used to treat or alleviate any chronic illnesses or conditions designated by the commissioner of health.
This bill also amends section 6810 of the Education Law by adding a new subdivision 5-a, to allow a prescription to be written for a three month supply of substances used to treat or alleviate any of the chronic illnesses or conditions that have been designated by the commissioner of health pursuant to regulations.
Justification
Prescription drugs can be a costly medical expense. Many New Yorkers do not have insurance for prescription drugs, including Medicare beneficiaries, seniors, people with disabilities, and those who have a chronic illness.
This legislation would reduce the incidence of co-payments, and lighten the financial burdens, allowing patients to buy prescriptions in bulk on a quarterly schedule. Middle income, seniors, as well as other New Yorkers with low and fixed incomes, need help with their prescribed maintenance drug costs, which they need to alleviate and/or treat their illnesses or conditions.
