Title of bill

An act to amend the correction law, in relation to requiring hotels or motels receiving money from the state to house registered sex offenders to notify potential customers that there are registered sex offenders staying on the premises

Purpose

The purpose of the law is to inform customers that there are sex offenders living in hotel/motels. Patrons have the right to know when making reservations or at the time they walk into a hotel/motel that sex offenders are being housed on the premise.

Summary of provisions

Section 168-c of the correction law is amended by adding a new subdivision 5 which states in the case of any sex offender residing in a hotel or motel contracting with the state or county shall be required to post a sign in a prominent and visible area behind the registration desk. If a reservation is being made via e-mail or by telephone, the customer shall be informed that a registered sex offender is residing on the premise.

Section 2 states this act shall take effect on the one hundred twentieth day after it shall have become law.

Existing law

This is a new bill.

Justification

Many families while on vacation stay at hotels/motels. In some cases, sex offenders are being housed there by the state or county without other guests being made aware. At these recreational facilities there are often times when parents feel safe and may allow their children to roam to the pool, go down the hall to get a bucket of ice, or go to the game room unattended, not suspecting that sex offenders are being housed there.

Unfortunately, unsuspecting children are at risk of falling prey to these sex offenders. For the safety of the parents and children, it should be made public knowledge by the hotel/motel that sex offenders are staying on the premise. Knowledge is an important tool for parents to effectively safeguard their children from danger.
