Title of bill
An act to amend the insurance law, in relation to requiring insurance policies covering surgery to cover all expenses incurred in connection with autologous blood transfusions
Purpose or general idea of bill
The purpose of this bill is to allow patients to have access to their own blood if needed as a result of surgery.
Summary of specific provisions
Amends §§3221 and 4303 of the Insurance Law to provide coverage for autologous blood transfusions used or intended to be used for surgery, including the collection of blood prior to surgery and the transfusion of blood into the insured if needed. Such coverage may be subject to annual deductibles and coinsurance as deemed appropriate by the superintendent.
Justification
Health insurers are not required to reimburse a patient for expenses related to donating his or her own blood if needed for a transfusion as a result of a surgical procedure. However, if the patient received a stranger's blood during a transfusion from an unknown source, insurers would provide full coverage. t is unreasonable for an insurer to refuse to provide coverage to a person who donates his or her own blood prior to the surgery while reimbursing for expenses related to receiving blood from a stranger.
