Purpose

To change the definition of "eligible project" under the New York State waste prevention program, to allow funding for end-of-pipe pollution control technology projects.

Summary of specific provisions

Section 1. Paragraph h of subdivision 1 of section 261 of the economic development law, is amended by chapter 471 of the laws of 1998.

Section 2. Paragraph e of subdivision 1 of section 264 of the economic development law, is amended by chapter 471 of the laws of 1998.

Justification

Under current law the Environmental Investment Program (EIP) is restricted from assisting projects that employ end-of-pipe control technologies to manage generated wastes. This results in many New York State businesses that utilize end-of-pipe pollution control technologies not being afforded the same financial assistance from the EIP as other pollution controlling businesses. Therefore by expanding the definition of eligible project under the New York State waste prevention program to include end-of-pipe pollution control technologies, these businesses will be eligible to receive EIP funding.
