Title of bill
An act to amend the criminal procedure law, in relation to granting animal abuse investigators of the county of Wayne peace officer status
Purpose
This legislation would grant animal abuse investigators of the county of Wayne peace officer status.
Summary of provisions
Section 2.10 of the criminal procedure law is amended by adding a new subdivision 77 which allows Animal Abuse investigator of the county of Wayne for the purpose of issuing appearance tickets permitted under article seven of such law, provided however that nothing in this subdivision shall be deemed to authorize such investigators to carry, possess, repair or dispose of a firearm unless the appropriate license thereof has been issued pursuant to Section 400.00 of the Penal law.
Justification
In their regular course of business, animal abuse investigators may encounter violations of New York State laws which prohibit cruelty to animals. However these public servants do not currently have the authority to issue appearance tickets, serve a summons or make arrests for such violations. This situation has hindered the enforcement of these laws, which are intended to help protect animals.
