Title of bill

An act to amend the public officers law, in relation to records requested through electronic mail

Purpose or general idea of the bill

The purpose of this bill is to require agencies to accept and respond to requests for records under the Personal Privacy Protection Law.

Summary of specific provisions

This bill would require each agency, when responding to requests for records under the Personal Privacy Protection Law, to accept records request submitted through electronic mail if such agency has reasonable means available. It also requires the agency to respond to such requests by electronic mail, wherever possible using form consistent with the forms developed by the Committee on Open Government.

Justification

Last year, the Freedom of Information Law was amended to require that agencies transmit requested records via electronic mail when they have the ability to do so. This bill would extend this provision to the related Personal Privacy Protection Law, which allows individuals who have data kept about them by New York State agencies to request copies of that information from the State. Legislation such as this helps increase the transparency and accountability of state agencies and further empowers individual citizens to control and monitor how their government operates.
