Title of bill
An act to amend the executive law and the mental hygiene law, in relation to requiring training for probation and parole officers in substance abuse and making an appropriation therefor
Purpose of bill
To require that Parole and Probation officers receive specific substance abuse training.
Summary of provisions
Amends Section 243 and 259-a of the Executive Law to require the Director of the Division of Probation and the Division of Parole, subject to the authority of the chairman, to provide probation officers, and parole officers, respectively, with substance abuse training and education programs. Such training shall include but not be limited to identification of controlled substances; identification of the physical signs of substance abuse/use; an awareness of the impact of substance abuse/use on the family unit; and the availability of drug treatment, prevention, education services, and appropriate referrals. Requires such programs to be developed in conjunction with the Division of Substance Abuse Services.
Amends Section 19.07 of the Mental Hygiene Law to require the Division of Substance Abuse Services to develop a substance abuse training, education program in conjunction with the Division of Parole and the Division of Probation and Correctional Alternatives.
A January 5, 1988 article on New York State Prisons in the ALBANY TIMES UNION stated that "more New York State inmates are serving time on drug related convictions than for any other type of offense". According to the State Department of Correctional Services, of the approximately 40,000 inmates in State prisons, 8,261 inmates (over 20%) were serving sentences on drug-related charges. Many inmates, upon release, return to the same environment where drug use/abuse activity may have occurred. These individuals, inevitably, return to the correctional system. It is important that Parole and Probation officers be provided with substance abuse education training. This training will help to decrease the recidivism rate of inmates through the State's penal system and ensure that inmate's families receive substance abuse services.
