Title of bill

An act to amend the vehicle and traffic law, in relation to permitting drivers of qualified hybrid vehicles to travel in high occupancy vehicle lanes

Purpose

To provide that operators of hybrid vehicles shall be permitted to travel in the high occupancy vehicle lanes regardless of the number of passengers in such vehicle.

Summary of provisions

Section 1. Adds a new section 1229-e to the vehicle and traffic law.

The term "qualified hybrid vehicle" means a motor vehicle that:

(i) draws propulsion energy from both:

(a) an internal combustion engine (or heat engine that uses combustible fuel); and

(b) an energy storage device; and

(ii) employs a regenerative vehicle braking system that recovers waste energy to charge such energy storage device.

The term "high occupancy vehicle lane" shall mean a lane reserved for designated types of vehicles and/or vehicles carrying a specified minimum number of occupants.

Justification

This legislation is designed to provide incentives to citizens who purchase a hybrid vehicle. Hybrid vehicles rely less on oil and gas, and are much more friendly to the environment. This legislation would waive current restrictions on HOV lanes, and permit access to people who own a hybrid vehicle.
