Title of bill

An act to amend the tax law and the state finance law, in relation to prohibiting the use of lottery funds for any purpose other than education

Purpose or general idea of bill

Prohibits use of lottery funds for any purpose other than education and prohibits co-mingling with funds for other purposes

Summary of specific provisions

Section 1612 of the tax law is amended by adding a new subdivision e

Section 1: Amends Tax § 1612 to add new subdivision (h) reading that no revenues collected pursuant to this article shall be used for any purpose other than providing aid to all school children and shall not be co-mingled with funds designated for any other purpose.

Section 2: Amends Finance §92-c(3) to state that the moneys in such fund shall be appropriated or transferred only for the repayment of the expenditures incurred in the operation of the state lottery provided that no moneys in such fund shall be appropriated or transferred for any purpose other than aid to school children and shall not be co-mingled with funds designated for any other purpose.

Justification

The lottery lockbox would ensure that lottery money is used for education, as it was meant to be. The public wants the assurance that lottery money that is coming for education is not going to be siphoned off for other things.
