Title of bill
An act to amend the administrative code of the city of New York, in relation to terminal leave
Purpose
Affords members of the New York City police force and fire department the option of taking a monetary payment in lieu of terminal leave.
Summary of provisions
§ 1 - amends the administrative code of the city of New York by adding a new § 14-152 - allowing members of the New York City police force to take a monetary payment in lieu of terminal leave.
§2 - amends the administrative code of the city of New York by adding a new § 15-129 - allowing members of the New York City Fire Department to take a monetary payment in lieu of terminal leave.
Existing law
Currently, members accrue terminal leave at a rate of three days for every year of service and can utilize such leave immediately prior to retirement.
Justification
Uniformed personnel of the NYC Departments of Correction and Sanitation perform essential services for the residents of the City of New York and risk grave physical injury as they provide this service. Retaining veteran members of the Department is essential to provide leadership for newer members of the uniformed service. Allowing for a monetary payment in lieu of terminal leave will help keep veteran members on the force beyond their dates for service retirements. Once the financial consideration of this benefit is removed, more veteran members will choose to remain in service thus preventing a "brain drain" from the department.
Legislative history
Similar legislation was vetoed in the 2006 Session. Vetoed Message 412 for the members of the police department and Veto Message 414 for members of the fire department.
