Title of bill
An act to amend the environmental conservation law, in relation to the definition of a primitive firearm
Purpose or general idea of bill
To define the meaning of "primitive firearm" under the NYS Department of Environmental Conservation (NYSDEC) law.
Summary of specific provisions
Section 11-0103 of the environmental conservation law is amended by adding a new subdivision 33 to read as follows: 33. "Primitive firearm" means any gun that: a. has a matchlock or flintlock ignition; b. uses patched round ball ammunition; and c. has iron sights.
Justification
The original intent of a special muzzleloaders season for taking of big game was to provide recreational opportunities for those hunters who wanted to experience a more primitive form of taking big game, the current legal types of muzzleloaders include those that are far from the original intent, and capabilities are more comparable to a modern cartridge firearm; whereas there is a growing desire by many traditional muzzleloaders to create additional opportunities to go afield with other hunters using like equipment. By creating this definition, it would provide the NYCDEC an additional tool to aid in management of the big game animals as well as provide additional recreational opportunities for some hunters.
