Title of bill
An act to amend the tax law, in relation to tax credit for certain retail tobacco dealers; and providing for the expiration of such provisions thereof
Purpose
To provide a tax credit to retail tobacco dealers located in proximity to Native American tribal cigarette outlets or retail tobacco dealers located in proximity to border states with lower cigarette excise taxes.
Summary of provisions
Amends the tax law by adding a new section 471-f to provide a tax credit to retail tobacco dealers located in proximity to either a Native American tribal cigarette outlet or a border state with a lower cigarette excise tax.
Justification
The State's failure to enforce the March 1, 2006 state law mandating collection of taxes on Indian sales of tobacco is inexcusable. The casualties for non-Indian retailers and state and local tax revenues are mounting. This legislation is an attempt to level the playing field the law requires and retail tobacco dealers deserve insofar as providing tax credits to retail tobacco dealers located near Native American tribal cigarette outlets as well as a border state with lower cigarette excise taxes.
