Title of bill
An act to amend the insurance law and the legislative law, in relation to proposed health insurance mandates
Purpose
To better ascertain the costs associated with proposed health insurance mandates.
Summary of provisions
The insurance law is amended by adding a new section 215 to establish the advisory council on health insurance mandates. Legislative law is also amended to direct bills which mandate health insurance benefits be sent to the advisory council for an opinion.
Justification
Despite a prolonged period of economic growth and low unemployment rates, the number of New Yorkers without health insurance is rising. Approximately 3.1 million New Yorkers are currently uninsured. The crisis is the result of many factors, including the high cost of health care. An appropriate balance needs to be reached between the mandated benefits that state law requires insurers to provide to their insureds and allowing insurers flexibility to structure their policies in a cost efficient manner to maximize resources available for the delivery of health care. Several bills are currently pending in the New York State Legislature which would mandate additional insurance coverages for specific medical procedures. This is a piecemeal approach which does little to improve the overall health of New Yorkers. There is a need for a comprehensive, coordinated review of proposed mandates before members of the Legislature are asked to vote upon specific inclusions.
