Title of bill
An act to amend the real property tax law, in relation to establishing a conservation agreement exemption in certain towns
Purpose
To enable the Town of Orchard Park to continue to operate the conservation easement program that they have been operating for years.
Justification
For many years the Town of Orchard Park has been operating a Conservation Easement Program pursuant to Section 247 of the General Municipal Law, to preserve open spaces within the town. The nature of this program has been to offer property owners a reduction in property taxes in exchange for a commitment to preserving undeveloped land.
The program was put on hold by the ORPS because the formula for calculating the easement resulted in reducing the assessed value of properties as they were reported on the assessment rolls. While the easement program was allowed to exist, the reduction in assessment created a problem with falsely reporting the assessments. There are currently numerous property owners . who entered into the Town's Easement Program, and their commitments extend beyond the current year. This legislation allows the Town to authorize a state tax exemption, which produces the same tax reduction for the property owners, but does so as an exemption rather than a change in property assessment.
This legislation is necessary to preserving a program that the Town of Orchard Park has been operating legally and effectively for many years. Without immediate passage of this legislation, those property owners who have made a commitment to non development will lose out on the benefits that they were promised upon entering into the program.
