Title of bill

An act to amend the municipal home rule law, in relation to requiring that certain local laws be subject to a mandatory referendum

Purpose

This bill provides that any change to a law that has previously been voted on by referendum be subject to further referenda before any such change can take effect.

SUMMARY OF PROVISIONS :Adds new paragraph 1 to subdivision 2 of section 23 of the municipal home rule law to change a provision of the law that has previously been voted on by the people through a referendum.

Justification

The purpose of a referendum is to provide the full electorate with an opportunity to have a direct input to either accept or reject a particular proposal. This legislation would ensure that any referendum voted on by people in the past must be voted on by referendum again prior to any changes being made.
