Title of bill

An act to amend the racing, pari-mutuel wagering and breeding law, in relation to the distribution of surcharges on off-track winnings

Purpose or general idea of bill

To restore the provisions of Chapter 681 of the Laws of 2007 which were mistakenly repealed by Chapter 18 of 2008.

Summary of specific provisions

Adds back into law the requirement that certain regional surcharge revenues are to continue to be distributed to a harness track in Erie County.

Effects of present law which this bill would alter

Restores the provisions of an extension in law of the surcharge distribution from 2007 to August 31, 2012 as provided for in Chapter 681 of 2007.

Justification

Chapter 681 of 2007 extended the provisions relating to the distribution of surcharge revenues from 2007 to 2012. However, because the effective date of that Chapter was 10.31.07, the drafters of subsequent 2008 legislation failed to notice the provisions of the October chapter and therefor considered the section which would have otherwise expired as archaic and OK to repeal.
