Title of bill

An act to amend the public officers law, in relation to charging for postage or waiving fees for the reproduction of records

Purpose or general idea of bill

Allows agencies to waive fees for the reproduction of records.

Summary of specific provisions

Provides that:

* Agencies shall be permitted to waive fees for the reproduction of records required by requests received under the Freedom of Information Law.

Justification

Since 1979, many agencies have routinely waived fees for small or routine FOIL requests, as the time and cost involved in doing the paperwork for such small transactions would exceed the amount that they could reasonably bill to the requesting party. Agencies should be given clear statutory authority enabling them to waive fees when it is sensible and cost effective to do so.
