Title of bill
An act to amend the agriculture and markets law, in relation to producer security
Purpose
The purpose of this bill is to raise, from $50,000 to $100,000, the maximum gross volume of farm products that an applicant for a farm products dealer license may purchase from producers during the license year and receive, in the discretion of the Commissioner of Agriculture and Markets (Commissioner), an exemption from the requirement that the applicant file a bond or letter of credit under Article 20 of the Agriculture and Markets Law (AML).
Summary of provisions
Section 1 of this bill would amend AML §250(3) to raise, from $50,000 to $100,000, the maximum gross volume of farm products that an applicant for a farm products dealer license may purchase from producers during the license year and receive, in the Commissioner's discretion, an exemption from the requirement that the applicant file a bond or letter of credit under AML Article 20.
Section 2 of this bill provides that the bill would become effective upon enactment, and apply to applications received after such date.
Existing law
AML §250(3) establishes $50,000 as the maximum gross volume of farm products that an applicant for a farm products dealer license may purchase from producers during the license year and receive, in the Commissioner's discretion, an exemption from filing a bond or letter of credit under AML Article 20.
Legislative history
This is a new bill.
Statement in support
Applicants for a farm products dealer license who will purchase more than $50,000 in farm products are currently subject to the regulatory burden of having to file a bond or letter of credit as security for the farm products they purchase from producers. This amount has remained unchanged since 1996, and can be a financial burden for small volume dealers.
This bill would authorize the Commissioner to reduce the financial burden on small volume dealers when appropriate by increasing, from $50,000 to $100,000, the value of farm products that such a dealer may purchase and still be considered for an exemption from AML Article 20's bond and letter of credit requirements.
Budget implications
None.
Effective date
This bill would become effective immediately upon enactment, and apply to applications received after such date.
