Title of bill
An act to amend the agriculture and markets law, in relation to notice of stated grape prices
Purpose
The purpose of this bill is to allow grape processors and their suppliers to operate more efficiently by allowing grape processors to provide certain notices to suppliers by facsimile and other electronic means.
Summary of provisions
Section 1 of this bill would amend Agriculture and Markets Law (AML) §250-f to authorize grape processors to use facsimile or other electronic means, in addition to the mails, to notify selling and delivering parties with whom they contract of (1) stated grape prices, and (2) the opportunity to refuse to deliver grapes pursuant to such contracts, provided that such parties have the ability to accept and have agreed to accept notification by such electronic means.
Section 2 of this bill would provide for an immediate effective date.
Existing law
AML §250-f requires grape processors to provide notice by mail to selling and delivering parties with whom the processors contract of (1) stated grape prices; and (2) the opportunity to refuse to deliver grapes.
Legislative history
This is a new bill.
Statement in support
Grape processors who have a contract with parties who sell or deliver grapes are currently limited to using the mail to notify these parties of the processors' stated grape prices and of the parties' opportunity to refuse to deliver grapes. Authorizing grape processors to provide such notification by facsimile or other electronic notice would allow grape processors and their customers to operate more efficiently. Customers may continue to receive such notification by mail if they lack the means to receive electronic notice or they choose not to receive electronic notice.
Budget implications
None.
Effective date
This bill would become effective immediately upon enactment.
