Title of bill

An act to amend the arts and cultural affairs law, in relation to the American Museum of Natural History Planetarium Authority

Purpose or general idea of bill

This bill will change the American Museum of Natural History Planetarium Authority board from being identical to the board of trustees of the Museum to a board consisting of members independent of the Museum. It will also separate the governance of the Museum from that of the Planetarium Authority, but allow for the Museum to continue the lease and operation of the planetarium building. The effect of the amendment is that it will make clear that the Museum is not an affiliate of the Planetarium Authority and will not be regulated as a public authority on the basis of any such affiliation. After the amendment, the Planetarium Authority will continue to be regulated as a public authority but the Museum will not.

Summary of specific provisions

Section one amends subdivisions 1 and 4 of section 59.03 of the arts and cultural affairs law to redefine terms.

Section two amends section 59.05 of the arts and cultural affairs law to specify the number of individuals that may serve as members of the board of directors of the Planetarium Authority and specify that these members shall be independent of the Planetarium Authority and the American Museum of Natural History. Justification

The Planetarium Authority was created by the New York State legislature in 1933 in order to support the construction of a planetarium for New York adjacent to the American Museum of Natural History (the "Museum") that would rival the planetariums set up in other U.S. cities and world capitals during the first part of the twentieth century. It was established with the purpose of "encouraging and developing the study of astronomical science; of advancing the general knowledge of kindred subjects," and training those who teach subjects related to astronomy. N.Y. ARTS & CULT. AFF. L. § 59.05 (McKinney 2008). Its board was formulated by this statute to be identical to the board of the American Museum of Natural History ("Museum"). The passage of the Public Authorities Accountability Act of 2005 ("Public Authorities Act"), however, has had a unique and, it is respectfully submitted, unintended impact on the Museum. Although the Museum is not within the scope of the Public Authorities Act as a quasi-governmental body.
