Title of bill

An act to amend the town law, in relation to the position of clerk to justice in the town of Windsor

Purpose or general idea of bill

Provides that the clerk to justice is not required to reside within the town of Windsor.

Summary of specific provisions

Section 1. section 23 of the town law is amended by adding a new subdivision 23 to read as tallows:

23. Notwithstanding the provisions of subdivision one of this section. in the town of Windsor, in the county of Broome the person holding the position of clerk to justice need not be an elector at such town. provided, however, the person holding the position of clerk to justice in any other town shall be an elector of such town, unless otherwise provided by law.

§ 2. Establishes the effective date.

Existing law

Provides that the clerk to justice is required to reside within the town of Windsor.

Justification

Currently, the position of clerk to justice for the town of Windsor is one that requires the holder of that position must be a resident of the town of Windsor. The requirement of Section 23 of the Town Law makes it very difficult for the small town such as Windsor to hire an individual with skills; knowledge, experience and who meets the requirements if they are only allowed to look within their town. This bill would allow the town to look in a broader spectrum for the right person for the job.
