Title of bill

An act to amend the town law, in relation to requiring that any local law or amendment to a local law relating to Peconic Bay community preservation funds shall be subject to a mandatory referendum pursuant to the municipal home rule law

Purpose

This act seeks to protect community preservation funds by requiring that any proposed changes to the CPF be subject to referendum.

Summary of provisions

Section 64-e of the Town Law is amended by adding a new subdivision 14.

Justification

Since being established in 1999, the Community Preservation fund has raised over half a billion dollars to support environmental efforts on the east end of Long Island. It is important that any effort to modify the provisions of the CPF does not weaken the fund. Requiring any local laws affecting the CPF to be passed by referendum assures a greater level of accountability.
