Title of bill
An act to amend the retirement and social security law, in relation to the retirement of members employed as investigators assigned to the department of law
Purpose
Permits department of law investigator to retire upon completion of 25 years of creditable service regardless of age.
Summary of provisions
Amends the retirement and social security law by adding a new section 89-x - creating a retirement plan for investigator members of the department of law:
* Covers investigators of the department of law who are considered police officers under the criminal procedure law * Members must be directly engaged in criminal law enforcement activities * Members will be eligible to retire upon completion of 25-years of creditable service at half pay * Creditable service shall means only time in title as an investigator and any applicable military service or uniformed service in a police force or paid fire department within this state
Existing law
Currently, investigators of the Department of Law are covered by the retirement plan according to their date of membership. Other police officers employed by other law enforcement agencies, including District Attorney's Office are provided better pensions benefits. Rockland County, Suffolk County, Westchester County, and all 5 NYC District Attorneys' offices and the Special Narcotics Prosecutor's Office all provide 20 year plans for their police officers.
Justification
Police officers employed by the NYS Department of Law/Office of the Attorney general have full police powers under the Criminal Procedure Law and perform identical police duties as federal, state and local law enforcement agencies. Frequently, they work side by side with them on multi-agency investigations performing indistinguishable functions, yet receive different pension benefits.
Investigators assigned to the Office of the Attorney General are law enforcement personnel who share the same risks as other law enforcement officials. Therefore they should be granted similar retirement benefits as other law enforcement officers. This bill would provide these officers the option of retiring after 25-years of service at one-half pay.
