Title of bill

An act to amend the administrative code of the city of New York, in relation to terminal leave

Purpose

Provides member of the New York City police force the option of taking a monetary payment in lieu of terminal leave

Summary of provisions

Amends §14-152 of the administrative code to allow members of the NYC police department the option of taking a monetary payment in lieu of terminal leave and the option of postponing the use of five vacation days per year and taking a monetary payment at the time of retirement.

Existing law

Currently, members accrue terminal leave at a rate of three days for every year of service and can utilize such leave immediately prior to retirement.

Justification

Retaining veteran police officers within the ranks of the New York Police Department is a paramount concern to the State and the City of New York. The New York City Police Department continues to face an unprecedented wave of retirements. A large number of police officers are quickly approaching 20 years of active service making them eligible for retirement. Thus, the department is confronted with a significant loss of its most experienced officers. As a result of recent budget cuts the size of New York City Police force has been drastically reduced. The NYPD has documented a serious diminishment in its most senior ranks over the last five years and retirements in the command structure of the department are expected to increase in the months ahead.

One way to allow veteran police officers to continue working is to grant them the option of deferring vacation and taking a monetary payment in lieu of their terminal leave. The leave and vacation payments would be paid at the rate applicable upon retirement. The bill will provide an incentive to officers to remain on the job and provide additional months of public protection at no additional cost.
