Title of bill
An act to amend the public health law, in relation to enforcement of regulations on sale and distribution of tobacco products and to repeal subdivision h of section 1607 of the tax law, relating to suspension of a lottery license for a violation of article 13-F of the public health law
Purpose
This bill changes which license is affected due to a violation of selling tobacco to minors.
Summary of provisions
This legislation amends Section 1607, subdivision h of the Tax Law. The amendment would take away a sales agent's tobacco license for selling to persons under 18 years of age.
Justification
Currently the sales agent's lottery license is suspended or revoked for selling tobacco to minors. The lottery license and tobacco license are two separate affairs. One license should not be taken away for an act committed by violating another license's regulations. A tobacco infringement should be dealt with by suspending or revoking a tobacco license and not a lottery license.
