Title of bill
An act to amend the retirement and social security law, in relation to credit for public service rendered in the state of New York under the federal Emergency Jobs Appropriation Act prior to becoming a member of a retirement system
Purpose or general idea of bill
This bill would allow for retirement credit to be earned under service in short term jobs created by or filled by the Emergency Jobs Appropriation Act.
Summary of provisions
Sections of the retirement and social security law are amended for the following:
Section 1: Criteria- This section is amended to gain retirement credit for jobs where service is rendered for more than two years, and will now include any service rendered under the Emergency Jobs Appropriation Act.
Section 2: Length- This section is amended to allow retirement credit to those who served in jobs under the Emergency Jobs Appropriation Act for any period of time. This is contingent with meeting the other requirements in this section.
Section 3: Eligibility- This section allows for members of Tier 1 to be eligible for this addition to compensation as well as members of other tiers affected by this law.
Justification
Federal employees who have rendered their services to agencies may only receive credit for a minimum of two years of service before entering a public retirement system. The Emergency Jobs appropriation Act of 1983 created nearly thirty five thousand (35,000) jobs of which many only last approximately one year. With many of the people who have served in these positions retiring, this would allow them to gain the proper credit for their service.
Prior legislation history
A.10235 (2007-2008)
Fiscal implications
This legislation would affect approximately seven hundred (700) people who served in jobs created by the Emergency Jobs Appropriations Act. For Tier 1 retirees this would amount to 12 (twelve) percent on average on top of their normal compensation. This total cost would be shared by New York State, and the employers in the New York State and Local Employees' Retirement System, and the New York State and Local Police and Fire Retirement System. For the remainder of retirees not in Tier 1 the cost would be negligible.
Effective date
This bill would take effect immediately after becoming law.
