Justification
This legislation would allow primary care service providers to charge their uninsured patients a monthly, flat rate payment for comprehensive medical services and treatment for numerous other medical conditions. These services range from medical care, office based surgeries, pediatrics, gynecological care, blood work, imaging (X-rays, sonograms) and physical therapy. Provider's who offer such flat rate payments want to give back to their community during these tough economic times without financial gain. Currently, the New York State Insurance Department has asked such providers, who are trying to deliver low cost health care to the uninsured, from charging a monthly flat rate because they are acting as an insurance business in violation of the law. After modifying this directive the Insurance Department now requires such providers to charge $33.00 for sick visits and limits such visits to 15 per year. This new restriction will cause hardship to the provider's patients and will discourage the uninsured from joining although the provider does not want to charge the $33.00 for sick visits and does not need it. This bill is similar to a law in the State of Washington that does not include primary care services under the insurance law.
