Title of bill
An act to amend the public health law, in relation to office-based surgery
Purpose
This bill makes a technical correction to Chapter 365 of the Laws of 2007 regarding the oversight of office-based surgery.
Summary of provisions
Section one amends paragraph (i) of subdivision 1 of Section 230-d of the Public Health Law by adding language to the definition of, 'Licensee" stipulating that it does not include an individual licensed under both Articles 131 and 133 of the Education Law who is practicing in a professional service corporation, or any other entity authorized only to engage in the practice of dentistry.
Existing law
None.
Justification
Chapter 365 of the Laws of 2007 enacted provisions, recommended by the Department of Health, regarding the oversight of office-based surgery. The intent of the measure was to provide oversight of physicians who perform surgical procedures in a location other than a hospital. Dentists were not intended to be included under this new statute. However, because some dentists are licensed physicians, the law has unintentionally brought their practices under the office-based surgery oversight provisions. This is a technical amendment that will correct that situation.
