* ABC Law § 97-a(1)(b) to give the SLA discretion to deem licenses abandoned for purposes of timely granting temporary permits to applicants seeking to do business in abandoned licensed premises.
* ABC Law § 97-a(2), renumbered as §97-a(4), to give the SLA discretion to grant multiple thirty day extensions to permittees.
* the ABC Law by adding a new § 97-a(2) to require package store permit applicants (ABC Law §§ 63 and 79) to show that a business licensed pursuant to the same section as that being sought by the applicant was open and operating within 30 days of filing the permit to comply with the public convenience and advantage requirements of licenses issued pursuant to those sections.
* the ABC Law by adding a new § 97-a(3) to require on-premises liquor permit applicants (ABC Law §§ 64, 64-a, 64-c, or 64-d) to show that a business licensed pursuant to the same section as that being sought by the applicant was open and operating at the time of the permit filing to comply with the 500 foot rule requirements for licenses issued pursuant to those sections.
* the ABC Law by renumbering the remaining subdivisions of . 97 -a to accommodate the above modifications.
Section 2 of the bill provides the effective date.
Existing law
The ABC Law currently provides for temporary retail permits for "transfer applications" only. As there is no other mention of "transfer applications" in the ABC Law, this has traditionally been a source of some confusion.
Legislative history
This is a new bill.
Statement in support
This bill requires the SLA to grant temporary retail permits while the process of reviewing applications is ongoing to respond to complaints from the business community regarding the untimely nature of the licensing process. The SLA also seeks to alleviate confusion regarding the mention of "transfer applications" in current ABC Law § 97-a.
Budget implications
None.
Effective date
This act shall take effect 180 days after enactment.
