Title of bill
An act to amend the insurance law, in relation to prohibiting insurers from discriminating on the basis of county of residence
Purpose
To protect seniors from losing health coverage due to the lack of profit for the insurer based on differing county reimbursements.
Summary of provisions
This bill amends the insurance law by adding a new section 2607-a.
Justification
Health Maintenance Organizations have been fleeing various counties over the last year leaving thousands of senior citizens stranded with no prescription drug coverage. The problem has been very acute in counties such as Suffolk where only two such HMOs remain. Due to arbitrary differences in reimbursement from the federal government from county to county for these health care organizations, many such organizations have stopped doing business in various counties. Insurance companies should not be able to cherry pick in this regard, leaving some counties covered while seniors in others are left to have to pay for their prescriptions out of their pockets. This bill would require that health insurance companies that cover in one part of the state extend coverage to all parts of the state.
