Title of bill

An act to amend the social services law and the executive law, in relation to permitting access to conviction records by certain employers

Purpose

This bill will help to ensure the safety and protection of families against potential violence from individuals with prior criminal histories and a propensity toward violence, who may be assigned to work on the grounds of or inside our constituents' homes.

Summary of provisions

Amends the Social Services Law by adding a new Section 378-b to provide access to conviction records by certain employers and amends Subdivision 8-a of Section 837 of the Executive Law, as amended by Section 1 of Part G of Chapter 52 of the Laws of 2003, to charge a fee when it conducts a search of its criminal history records and returns a report thereon.

Justification

The people of our state are entitled to be safe in their homes and secure in their belief that reasonable efforts have been made and taken to ensure that safety and protection and to guard against home invasion and potential violence from those with prior criminal histories and/or a propensity toward violence.

This act will provide that individuals employed to do work or to perform services on the exterior or residences or close proximity to homeowners and their families and/or inside the residences have been properly vetted to determine that they are presumptively safe and can be reasonably expected to pose no threat or in the alternative if they have a background of criminal activity or violence that they will be weeded out and eliminated from such sensitive positions so as to remove potential danger(s) to our citizens.
