Title of bill

An act to amend the public health law, in relation to who may certify that an immunization may be detrimental to a child's health

Purpose of bill

This bill is intended to add nurse practitioners to the category of persons qualified to certify that an immunization required by section 2164 of the public health law may be detrimental to a child's health.

Summary of specific provisions

This bill adds nurse practitioners to the category of persons qualified to certify that an immunization required by section 2164 of the public health law may be detrimental to a child's health.

Justification

A very small number of children suffer from medical conditions, such as unusual allergies, that make certain immunizations hazardous to their health. The public health law recognizes this problem, and provides that a physician licensed to practice medicine in New York may certify that an immunization required by section 2164 may be detrimental to a child's health. Such certification has the effect of rendering inapplicable the immunization requirement until the immunization is found no longer to be detrimental to the child's health.

Nurse practitioners have the training, skill, and familiarity necessary to recognize and certify pediatric patients who are at risk of detrimental health effects from vaccines. In the interest of common sense and efficiency, nurse practitioners should be recognized as capable of making such certification when necessary. This bill accomplishes that end.
