Title of bill
An act to amend the tax law, in relation to extending the authorization of the county of Yates to impose an additional one percent of sales and compensating use taxes
Purpose
To authorize the Yates County Legislature to continue to impose an additional 1% sales tax for a 2 year period.
Summary of provisions
The bill amends section 1210 of the tax law to authorize the County to impose an additional 1% sales tax from the period November 30, 2009 to November 30, 2011.
Existing law
Section 1210(i) (30) of the tax law currently authorizes the imposition of an additional 1% sales tax in Yates County from November 30, 2007 to November 30, 2009.
Justification
The Yates County Legislature has passed a resolution requesting that the New York State Legislature introduce and pass a bill to re-authorize the county to impose an additional 1% sales and use tax for the period November 30, 2009 through November 30, 2011. The increase is necessary because Yates County is facing a fiscal crisis due to escalating Medicaid costs. Yates County has determined that an increase in the real property tax would unduly burden real property owners and that a continuation of the sales tax increase is the preferred method of raising revenue that the County needs to meet its increasing financial commitments. The 1% tax is expected to generate an additional 2 million dollars in new revenue per year to be used by the County and municipalities to meet their obligations to residents.
