Title of bill
An act to amend the town law, in relation to the requirement of fire districts to hold public hearings before submitting their budgets to the town
Purpose
This bill would allow fire districts and companies to schedule a public hearing on their submitted budgets on either the first, second, or third Tuesday or Wednesday, or first or third Monday in October of each year.
Summary of provisions
Section 1, subdivision 3 of section 181 of the town law, as amended by chapter 555 of the laws of 2007 is amended to allow the board of commissioners of fire districts or companies to hold a public hearing on either the first, second, or third Tuesday or Wednesday, or first or third Monday in October of each year.
Justification
Town law section 181 was amended in 2007 to require fire districts throughout the state to hold a public hearing on the third Tuesday in October of each year regarding their proposed budgets for the upcoming fiscal year. Unfortunately, the month of October contains several religious holidays as well as Columbus day and the possibility arises that the required hearing will fall on one of these days, thereby precluding citizens from attending. This bill will provide fire districts with the flexibility to schedule said hearings around Columbus day and any religious holidays in the month of October.
