Title of bill

An act to amend the public officers law and the education law, in relation to removal of school district officers who have been convicted of a felony or crime involving violation of oath of office

Purpose or general idea of bill

This legislation would provide clarification that every school officer is a public officer of the state.

Summary of specific provisions

This legislation amends the Public Officers Law and the Education Law to clarify that school officers are public officers and are governed by the Public Officers Law.

Justification

It is well established in case law and administrative opinions that school board members and other school officers are public officers subject to the Public Officers Law. SEE E.G., WONG V. NEW YORK STATE BOARD OF ELECTIONS , 82 Misc. 2d 521, 522 (SupCt, New York County 1975); 1971 Op. Atty Gen (Inf) 7; 1999 Op. Atty Gen (Inf) 3.) However, current state statute does not clearly indicate this designation. This bill simply amends pertinent sections of Public Officers and Education Laws to reflect current law and practice.

Legislative history

Fiscal implications
