BILL NUMBER:S4322B

Title of bill

An act to amend the social services law, in relation to landlords of housing accommodations occupied by recipients of public assistance

Purpose

To require owners of buildings in which recipients of public assistance reside to file a form stating that such building is up to all applicable codes.

Summary of provisions

Section 1: Requires owners of buildings containing public assistance residents file a form proving that that such building is up to all applicable codes. Such form shall be notarized and resubmitted every 6 months. The bill further authorizes the DSS to withhold payments to a landlord if the owner has failed to file such form. Section 2: Is the effective date.

Justification

This bill would require that the owner of a building containing the housing accommodations into which the recipient of public assistance and care intends to move shall file with the local department of social services a verified statement that the building containing the housing accommodations meets all applicable building codes, ordinances, and regulations of the municipality where the building is located. The local social services department would be authorized to withhold public assistance payments to a landlord or to any other person for or toward the rental of any housing accommodations occupied by public assistance recipients. The verified statement would have to be filed prior to any payment being made by or on behalf of the local department of social services. A statement would have to be filed every 6 months.
