Title of bill
An act to amend the election law, in relation to providing that designating petitions and independent nominating petitions may not contain candidates for the same public office from different political subdivisions
Purpose
Section 1: Amends Election Law section 6-134 subdivision 1 to prohibit the combining of the petitions of two candidates for the same public office in different political subdivisions.
Section 2: Provides that the Act takes effect immediately.
Existing law
Under the existing law,
Justification
In the case of Popkin v. Umane, 22 AD2d613 (2nd Dep't 2005), the Appellate Division held that petitions which contained the names of different candidates for the same public office in different political subdivisions are valid. This holding could be interpreted to allow one petition to be used for a candidate of a party in each of the Assembly Districts in New York City, placing a heavy burden of the board of elections to determine which signers resided in each of the candidates' political subdivision.
